หลักสูตร LLM กต. รับรอง 2565-2566 | Study LLM in the UK 2023-2024

ข้อมูลเบื้องต้นเกี่ยวกับการสอบผู้ช่วยผู้พิพากษา รายชื่อมหาวิทยาลัย และหลักสูตร LLM ที่ ก.ต.รับรองใน UK (ข้อมูลล่าสุด 2023 -  2024)* *คัดย่อจากบทความโดย: ท่าน Thita Pithaksantisook (View)

  การศึกษาวิชากฎหมายต่อในต่างประเทศเพื่อกลับมาสอบผู้ช่วยผู้พิพากษาเราเลือกเรียนได้ 3 แบบ คือ

  1. LLM in General 2 ใบ โดยต้องเรียนวิชาบังคับตามที่ก.ต.กำหนด 6 วิชา ได้แก่ กฎหมายอาญา 1 วิชา กฎหมายแพ่งและกฎหมายพิเศษรวมกัน 4 วิชา กฎหมายพยานหลักฐาน, กฎหมายวิธีพิจารณาความอาญา/แพ่ง, หรือกฎหมายล้มละลาย 1 วิชา
  2. LLM in General 1 ใบ และ LLM in Specialization 1 ใบ or LLM in Specialization ทั้ง 2 ใบ Specialization หมายถึง วิชากฎหมายเด็กและเยาวชน กฎหมายแรงงาน กฎหมายภาษีอากร กฎหมายทรัพย์สินทางปัญญา กฎหมายการค้าระหว่างประเทศ กฎหมายพาณิชย์นาวี หรือกฎหมายล้มละลาย
  3. LLM in General 2 ใบ เรียนวิชาบังคับตามที่ก.ต.กำหนดเพียง 2 วิชา ซึ่ง 1 วิชาจะต้องเป็น กฎหมายอาญา หรือ กฎหมายลักษณะพยานหลักฐาน หรือกฎหมาย วิธีพิจารณาความอาญา หรือ กฎหมายวิธีพิจารณาความแพ่ง หรือกฎหมายล้มละลาย หรือ กฎหมายแพ่ง ซึ่งพอเทียบได้กับลักษณะใดลักษณะหนึ่งในประมวล กฎหมายแพ่งและพาณิชย์ และ เรียนวิชาเฉพาะ (Specialization) ทางสาขาใดสาขาหนึ่งอีก อย่างน้อย 4 วิชา
คำถามในการเข้าสอบในสนามจิ๋ว ว่าเมื่อไปศึกษาแล้วเราควรจะเรียนวิชาใดบ้างเพื่อให้กลับมามีคุณสมบัติที่จะสอบผู้ช่วยผู้พิพากษาได้ ในข้อนี้เราสามารถเลือกเรียนวิชากฎหมายในต่างประเทศได้ 2 ทางเลือก กล่าวคือ
  1. ถ้าเราเลือกเรียนในหลักสูตร LLM ในต่างประเทศ ซึ่งมีชื่อหลักสูตรว่า LLM General นั้นหมายความว่าเราในการเรียนปริญญาสองใบนั้น เราต้องเลือกเรียน วิชาดังต่อไปนี้ให้ครบถ้วน รวม 6 วิชา จึงจะครบคุณสมบัติตามระเบียบ
    1. วิชากฎหมายอาญา
    2. วิชากฎหมายแพ่ง ซึ่งพอเทียบได้กับลักษณะใดลักษณะหนึ่งในประมวลกฎหมายแพ่งและพาณิชย์ รวม 4 วิชา (เช่นสัญญา, ซื้อขาย, ทรัพย์สิน, ประกันภัย เป็นต้น) หรือ วิชากฎหมายแพ่ง ซึ่งพอเทียบได้กับลักษณะใดลักษณะหนึ่งในประมวลกฎหมายแพ่งและพาณิชย์และกฎหมายพิเศษตามที่ระบุท้ายระเบียบนี้ รวมกันแล้วไม่น้อยกว่า 4 วิชา และ
    3. กฎหมายลักษณะพยานหลักฐาน หรือกฎหมายวิธีพิจารณาความอาญา หรือกฎหมายวิธีพิจารณาความแพ่ง หรือกฎหมายล้มละลาย
    ดังนั้นในการเรียนปริญญาโทในต่างประเทศสองใบเราจะถูกบังคับให้ต้องเลือก เรียนวิชาดังกล่าว ทั้งสิ้นให้ครบ รวม 6 วิชา ซึ่งจะทำให้เรามีคุณสมบัติที่จะสอบเป็นผู้ช่วยผู้พิพากษาได้
  2. ถ้าเราเลือกเรียนหลักสูตร LLM ในต่างประเทศ สองใบ แต่ว่าเราไม่ต้องการที่จะเรียนวิชาที่ก.ต.บังคับตาม ทางเลือกที่หนึ่งทั้ง 6 วิชา เราก็ต้องเลือกเรียนในกรณีใดกรณีหนึ่งดังต่อไปนี้ จึงจะมีคุณสมบัติครบถ้วนเพื่อที่จะสอบผู้ช่วยผู้พิพากษา
    1. เลือกเรียน เป็น LLM in …(Specialization)… เช่น LLM in Taxation, LLM in Intellectual Property Law เป็นต้น ซึ่งตามที่ ก.ต.กำหนด ไว้ ตามข้อ ๗ วรรคสอง (๑) ระเบียบฯ [3] กล่าวคือ เราต้องศึกษาตามหลักสูตรการศึกษากฎหมายที่จัดไว้เป็นหลักสูตรเฉพาะด้านในวิชา

      2. 1. กฎหมายเด็กและเยาวชน

      2. กฎหมายแรงงาน

      3. กฎหมายภาษีอากร

      4. กฎหมายทรัพย์สินทางปัญญา

      5. กฎหมายการค้าระหว่างประเทศ

      6. กฎหมายพาณิชย์นาวี

      7. กฎหมายล้มละลาย

    2. เลือกเรียนกลุ่มวิชาเฉพาะด้านกลุ่มใดกลุ่มหนึ่ง ซึ่งได้แก่ วิชากฎหมายเด็กและเยาวชน กฎหมายแรงงาน กฎหมายภาษีอากร กฎหมายทรัพย์สินทางปัญญา กฎหมายการค้าระหว่างประเทศ กฎหมายพาณิชย์นาวี หรือกฎหมายล้มละลาย ไม่น้อยกว่า 4 วิชา และเรียนวิชาตามทางเลือกที่ 1 ด้วยอีกไม่น้อยกว่า 2 วิชา โดยใน 2 วิชานี้ อย่างน้อย 1 วิชา จะต้องเป็น

      3. 1. วิชากฎหมายอาญา

      2. วิชากฎหมายลักษณะพยานหลักฐาน หรือกฎหมายวิธีพิจารณาความอาญา หรือกฎหมายวิธีพิจารณาความแพ่ง หรือกฎหมายล้มละลาย

      3. วิชากฎหมายแพ่ง

      ซึ่งพอเทียบได้กับลักษณะใดลักษณะหนึ่งในประมวลกฎหมายแพ่งและพาณิชย์

การเลือกเรียนในกรณีนี้เท่ากับว่าเราไม่ต้องเลือกเรียนในหลักสูตร LLM in Specialization ในต่างประเทศ คือเลือกเรียนเป็น LLM in General ทั้งสองใบเลยก็ได้ แต่ว่า เวลาเรียนเราเลือก เรียนวิชาเฉพาะทางซึ่งได้แก่ 6 วิชาที่กล่าวมาข้างต้น โดยเลือกเฉพาะทางด้านใดด้านหนึ่ง เรียนวิชาสาขานั้นๆ ให้ครบอย่างน้อย 4 วิชา แล้วเราก็เรียนวิชาที่ ก.ต.บังคับ อีก 2 วิชา แต่จะเรียนวิชากฎหมายพิเศษ ทั้งสองวิชาเลยไม่ได้ เรียนได้แค่ตัวเดียว อีกตัวต้องเรียน

1.วิชากฎหมายอาญา

2.วิชากฎหมายลักษณะพยานหลักฐาน หรือ กฎหมายวิธีพิจารณาความอาญา หรือ กฎหมายวิธีพิจารณาความแพ่ง หรือ กฎหมายล้มละลาย

3.วิชากฎหมายแพ่ง ซึ่งพอเทียบได้กับลักษณะใดลักษณะหนึ่งในประมวลกฎหมายแพ่งและพาณิชย์
